  4.     Germany found itself mired in the increasingly heated European
  5. debate over drug legalization last week when an appellate judge
  6. in Lubeck declared the country's laws against marijuana and
  7. hashish unconstitutional. In a ruling that must now be tested in
  8. the nation's highest court, Judge Wolfgang Neskovic overturned
  9. the conviction of a woman who had been caught hiding 1.2 grams
  10. of hashish in her sock.

  12.     The surprise decision seems destined to further distance
  13. the ruling Christian Democrats, who seek stricter enforcement
  14. of antidrug laws, from the opposition Social Democrats, who
  15. appear inclined to support drug-legalization proposals that
  16. would make Germany more like the Netherlands, where 2,000
  17. coffeehouses openly sell marijuana and hashish. Ruled Neskovic:
  18. "Intoxication, like eating, drinking and sex, is one of the
  19. fundamentals of mankind." The judge himself confessed to
  20. preferring seltzer water to cannabis.
